HMO rules in Swindon

A House in Multiple Occupation (HMO) is a property let to three or more people who form more than one household (e.g. unrelated tenants sharing). HMOs in Swindon must meet safety and management standards, and many require a licence from Swindon Borough Council. This guide explains when a licence is needed and what landlords must do.

When is a property an HMO?

A property is typically an HMO if at least three people from more than one household live there and share facilities (bathroom, kitchen). Some smaller HMOs (e.g. three people in two households) are "mandatory" HMOs for licensing; others may be "additional" if the council has extended licensing. Check the council and GOV.UK for the exact definitions that apply to your property.

When do you need an HMO licence?

Mandatory HMO licensing applies to properties with five or more people in more than one household sharing facilities. Councils can also introduce "additional" or "selective" licensing for other HMOs or rental properties in certain areas. Swindon Borough Council’s website states whether your property needs a licence and how to apply. Operating without a required licence can result in fines and restrictions on rent.

Standards and duties

HMO landlords must meet safety requirements (gas, fire, electrical), provide adequate facilities, and keep the property in good repair. Licence conditions may set maximum occupancy, room sizes, and management standards. The council can inspect and take enforcement action if standards are not met.
